The Kshs. 157 Million Wake-Up Call: Qureshi v. Parkar [2025]
If you believe that “implied consent” or “doctor’s discretion” is still a valid legal defense in Kenya, the landmark June 2025 High Court ruling in Naila Qureshi & Another v. Dr. Raffique Parker & 2 Others serves as a definitive correction.
In this case, a patient consented to a hysterectomy. However, the surgeon proceeded to remove her cervix without her explicit, informed command. The procedure was performed unskilfully, leading to a lifelong, debilitating vesico-vaginal fistula (VVF).
The High Court did not merely compensate the injury; it punished the breach of autonomy. Justice Alexander Muteti awarded a record-breaking Kshs. 157,207,524.20 (Approx. USD $1.2 Million).
The Court’s message was unambiguous: Clinical skill is not a license for colonization. A doctor’s degree does not grant them the power to bypass the Sovereign Citadel.
The Constitutional Triple Lock
Why did the Court award such a staggering amount? Because the Constitution of Kenya (2010) has elevated informed consent from a medical formality to a Constitutional Imperative. Your body is protected by a “Triple Lock” of rights:
- Article 28 (Dignity): You have inherent value that is inviolable. Paternalism treats you as a biological object; the Law treats you as a moral agent whose choices are sacred.
- Article 29 (Freedom and Security): This protects you from Medical Battery. Any unauthorized physical interference, even if intended to “help”, is a violation of your personal security.
- Article 43 (Right to Health): The right to the highest attainable standard of health includes the Right to Information. You cannot be healthy if you are kept in the dark about what is happening to your own body.
The S.C.A.N. Framework: How to Protect Your Citadel
